Binding death benefit nominations

Binding death benefit nominations (BDBNs) are an extremely useful estate planning tool, but we are seeing an increase in disputes about technical compliance of the document, the role of the trustee and how the BDBN works with the overall estate planning.

In this webinar, Hayley and Sarah will look at:

  • who should have a BDBN, and who should be nominated as the beneficiary
  • how carefully the BDBN needs to comply with the rules of the Fund, and what happens when the rules of the Fund differ from the requirements in the legislation
  • how to draft a future-proof BDBN, including looking at waterfall provisions, and planning for incapacity
  • other things to look at when making a BDBN
  • examples of BDBNs ‘gone wrong’.
