Miranda Klibbe

Partner
Miranda’s approach to client management is to ensure she has a sound and comprehensive understanding of her clients’ desired outcomes at the outset of any matter.

Miranda is a partner in Cooper Grace Ward’s litigation and dispute resolution team. Miranda has worked with both large corporate clients and private clients on a wide variety of litigated matters.

Miranda has particular expertise in handling commercial litigation arising from property and contractual disputes. She has a particular interest in property litigation, having experience in working on wide ranging property disputes, including leasing disputes, property sale disputes and disputes involving registered and unregistered interests in land.

Commercial Litigation:

  • Working with large organisations on product and liability disputes.
  • Representing clients in building and construction litigation with simultaneous litigation in the Supreme Court and the Queensland Civil and Administrative Tribunal.
  • Representing a large corporation in significant Supreme Court litigation, including a successful appeal to the Court of Appeal.
  • Working on complex body corporate disputes, before the Commissioner for Body Corporate and Community Management and the Queensland Civil and Administrative Tribunal.
  • Experience in representing both plaintiffs and defendants in proceedings in the Supreme, District and Magistrates Court in Queensland, and Federal and interstate courts.

Debt recovery:

  • Acting for both large corporate clients and businesses in contested and uncontested debt recovery proceedings.
  • Experienced in enforcing judgments, including bankruptcy and winding-up proceedings.

Alternative dispute resolution:

  • Representing clients at settlement conferences and mediations to achieve a commercial resolution to their disputes.
  • Working with clients to negotiate early resolution and settlements to their disputes.

Defamation perspectives: separate 'serious harm' hearings and the Federal Court

Defamation actions include a ‘serious harm’ threshold that often enables respondents to more readily dispose of complaints that do not result in significant damage to the claimant’s reputation. The recent decision in Peros v Blackburn highlights one pitfall for parties defending defamation actions in seeking separate ‘serious harm’ hearings in the Federal Court, and raises whether the Federal Court Rules require amendment to better align with the defamation legislation of the states and territories.

Digital age pitfalls with BIF Act claims

The digital age has certainly enhanced our ability to convey information, something that is very important in the building and construction industry. However, technology can also create pitfalls, particularly when it comes to claims under the Building Industry Fairness (Security of Payment) Act 2017 (Qld), where compliance with technicalities is critical. The case of Iris Broadbeach Pty Ltd v Descon Group Australia Pty Ltd gives a recent illustration.
